Upcoming Capital Gains Tax (CGT) Changes: What You Need to Know

Significant updates to Capital Gains Tax rules are coming into effect, introducing a new 30% tax rate framework, valuation rules as at 1 July 2027, the cessation of the 50% CGT discount, the reintroduction of indexation, and important grandfathering provisions for existing assets.

Whether you are managing investment property, shares, or private business assets, understanding how these transitional rules affect your portfolio is crucial for long-term tax planning.

Key Highlights:

  • 30% Minimum CGT Floor: From 1 July 2027, real capital gains (after indexation) accrued post-transition are subject to a minimum tax floor of 30%, meaning gains can no longer be offset down to lower individual marginal tax brackets.
  • Superannuation High-Balance Threshold (Division 296): Earnings—including capital gains—attributable to total superannuation balances exceeding $3 million will incur an additional 15% tax, bringing the total rate on that portion to 30%.
  • High Yield & Trust Withholding: From 1 July 2028, discretionary trustees will be required to withhold tax at a flat rate of 30% on distributions (including capital gains), preventing income streaming to lower tax-bracket beneficiaries.
  • Valuation Baseline (1 July 2027): Assets held before 1 July 2027 will need to be valued on 1 July 2027 to establish their new cost base.
  • 50% CGT Discount Ceases (1 July 2027): The general 50% CGT discount for individuals and trusts will no longer apply to capital gains accrued after 1 July 2027.
  • Reintroduction of Indexation: Cost base calculations post-1 July 2027 will reintroduce indexation for inflation to calculate your real net capital gain.
  • Grandfathering Rules: Protectable assets, transitional relief options, and key compliance deadlines for assets acquired before the implementation date.
